Thomas R. Shahady has been actively involved in commercial litigation since 1965. He has tried numerous jury and non-jury matters in State and Federal Courts. His areas of interest include construction litigation and complex commercial and real estate litigation. He represents sureties, insurance carriers, major developers, general contractors, subcontractors and nationally recognized material suppliers, as well as other parties involved in the construction industry. Mr. Shahady was involved in redrafting the Florida Construction Lien Law in 1978 and has lectured extensively to The Florida Bar and building/trade associations throughout the State of Florida to attorneys and lay groups regarding construction law.
In addition, Mr. Shahady has extensive experience in business litigation, including patent infringement and securities litigation. He has obtained multi-million dollar jury verdicts in patent infringement, securities and construction litigation matters. He has also successfully defended against multi-million dollar claims on behalf of sureties and insurance carriers.
He is a Martindale-Hubbell AV® Preeminent™ rated attorney, the highest possible rating by the most widely recognized attorney rating organization in the world. He has also been named as one of the top 25 construction litigation lawyers in South Florida by Super Lawyers® for several years.
He received his B.A. from Wheeling College in West Virginia in 1962 and his J.D. from the University of Florida in 1965. He is a member of The Florida Bar, the Broward County Bar Association, and a lifetime member of the Gold Coast Builders Association.
Mr. Shahady is admitted to practice before the U.S. District Court for the Southern District of Florida, the U.S. Supreme Court, the Supreme Court of Florida, the 11th Circuit Court of Appeals, the 5th Circuit Court of Appeals, the Federal Circuit Court of Appeals, the U.S. District Court of the Eastern District of Michigan and the State Courts of Florida.
Mr. Shahady has been personally involved in construction litigation since 1973. He has handled construction defect claims on behalf of The Hartford Insurance Group, Travelers Insurance Companies, Liberty Mutual Insurance and Crum and Forster Specialty Insurance Companies. He has also represented the interests of AIG Insurance in several construction defect claims. In addition, he has represented The Mountbatten Surety Company and First Sealord Surety Company throughout the State of Florida for all of their construction defect claims against their payment and performance bonds.
He has participated in over 100 jury trials dealing with construction defect claims. His practice experience is equally shared in the representation of plaintiffs regarding affirmative construction claims and defendants regarding the defense of construction defect claims. He also serves as a mediator in construction and civil litigation cases.
When Mr. Shahady is not practicing law, he serves on the Board of Governors at Lago Mar Country Club, where he is a past President. He also participates in charities such as the Cystic Fibrosis Foundation, A Child is Missing and the Heart Association of Broward and Palm Beach Counties.
